About the job
Job Description
We are currently seeking Contracts Engineers, reporting directly to the Contracts Manager, to join the team based in Zour, KIPIC, Kuwait.
Role Summary:
As a Contracts Engineer, you will be responsible for managing pricing, contract law, drafting, administration, negotiation of change orders, effective correspondence, planning, and scheduling. You will also oversee subcontract formation and administration, bidder pre-qualification, bid evaluations, performance monitoring, and the resolution of claims and disputes.
Key Responsibilities:
- Participate in all project meetings regarding status, scope, cost, and scheduling.
- Identify appropriate contract flow-down requirements for purchase orders and subcontracts.
- Collaborate closely with Project Controls to monitor contract schedule performance and cost trends.
- Prepare consolidated analysis of contract terms and conditions, highlighting risk areas and recommending mediation strategies.
- Assist in reviewing and analyzing project financial data and client progress payments to ensure compliance with contract terms.
- Support the Project Manager or Site Construction Manager in negotiating changes to the contract baseline and resolving constructive contract changes.
- Coordinate compliance with contract obligations, including reviews of incoming and outgoing correspondence, submittals, and certificates of insurance.
- Develop and implement the project Subcontracts Management Program.
- Review and approve bid tabulations and recommendations consistent with client requirements.
- Monitor contract quality, cost, and performance to ensure all contractual duties and obligations are fulfilled by subcontractors.
- Liaise with project team members to resolve subcontractor and vendor claims.
Proposal / ITT (Invitation to Tender) Responsibilities:
- Manage all contract inputs and coordinate work performed by contracts personnel allocated to an ITT.
- Provide recommendations on subcontract strategy, forms for subcontract, and special conditions.
- Assist in managing risk identification and mitigation for the ITT.
- Participate in client negotiations on all contract issues, in liaison with Legal.
- Prepare and review Memorandums of Understanding (MOU), single-source agreements, and consortium agreements.
Requirements:
Mandatory:
- Excellent written and oral communication skills.
- Effective contract negotiating skills.
- Team player who can work to strict deadlines.
- Confident individual with sound commercial awareness and contract knowledge.
- General management and project management skills.
- Demonstrated ability to determine client needs, identify solutions, and communicate progress.
Software Knowledge:
- Proficiency in MS Office.
Advantageous:
- PMC experience.
- Ex-Technip experience.
Minimum Experience:
- 12 years of total work experience.
- 8 years in Oil & Gas / Refinery / Petrochem industry.
- 5 years in a related designation/discipline.

المسؤوليات الرئيسية:
- المشاركة في جميع الاجتماعات المتعلقة بحالة المشروع، النطاق، التكلفة، والجدول الزمني.
- تحديد المتطلبات المناسبة للعقود لأوامر الشراء والعقود الفرعية.
- التعاون عن كثب مع فريق التحكم في المشروع لمراقبة الأداء والاتجاهات في التكلفة والجدولة.
- إعداد تحليل شامل لشروط وأحكام العقد مع التركيز على مناطق الخطر وتقديم توصيات لحلها.
- المساعدة في مراجعة وتحليل البيانات المالية للمشروع ودفع التقدم من العميل لضمان الامتثال لشروط العقد.
- دعم مدير المشروع أو مدير الإنشاءات في التفاوض بشأن التغييرات على الأساس العقدي وحل التغييرات التعاقدية البناءة.
- التنسيق لضمان الامتثال للالتزامات التعاقدية، بما في ذلك مراجعة المراسلات القادمة والصادرة، وتقديم الشهادات.
- تطوير وتنفيذ برنامج إدارة العقود الفرعية للمشروع.
- مراجعة والموافقة على الجداول الزمنية للعروض والتوصيات بما يتماشى مع متطلبات العميل.
- مراقبة جودة العقد وتكاليفه وأدائه لضمان الوفاء بالواجبات والالتزامات التعاقدية من قبل المقاولين الفرعيين.

- إدارة جميع مدخلات العقود وتنسيق العمل الذي يقوم به أفراد العقود المخصصين لدعوة تقديم العطاءات (ITT).
- تقديم توصيات حول استراتيجية العقود الفرعية، نماذج العقود، والشروط الخاصة.
- المساعدة في إدارة تحديد المخاطر والتخفيف منها للعطاء.
- المشاركة في المفاوضات مع العملاء حول جميع القضايا التعاقدية بالتنسيق مع القسم القانوني.
- إعداد ومراجعة مذكرات التفاهم (MOU)، واتفاقيات المصادر الفردية، واتفاقيات الكونسورتيوم.
المتطلبات:
الإلزامية:
- مهارات ممتازة في الكتابة والتواصل الشفوي.
- مهارات فعالة في التفاوض على العقود.
- لاعب فريق قادر على العمل ضمن مواعيد نهائية صارمة.
- شخص واثق لديه وعي تجاري قوي ومعرفة بالعقود.
- مهارات الإدارة العامة وإدارة المشاريع.
- قدرة مثبتة على تحديد احتياجات العميل، وتقديم الحلول، والتواصل المستمر حول تقدم العمل.
المعرفة البرمجية:
- إتقان MS Office.
مزايا إضافية:
- خبرة في إدارة المشاريع (PMC).
- خبرة سابقة مع Technip.
الخبرة الأدنى:
- 12 عامًا من الخبرة المهنية.
- 8 سنوات في صناعة النفط والغاز / التكرير / البتروكيماويات.
- 5 سنوات في نفس التخصص أو المسمى الوظيفي.
